U.S. BIS suspends expansion of end-user controls
Suspension of interim rule that aimed to automatically subject entities at least 50% owned by listed entities to Entity List restrictions
The Bureau of Industry and Security (BIS) of the U.S. Department of Commerce today released a final rule imposing a one-year suspension of the interim final rule, “Expansion of End-User Controls to Cover Affiliates of Certain Listed Entities.” The suspension is set to end on November 9, 2026, unless extended.
The interim final rule, initially published in September 2025, aimed to automatically subject entities at least 50% owned by listed entities to Entity List restrictions. Read TradeNewsFlash
BIS will evaluate U.S. national security and foreign policy interests related to these non-listed foreign affiliates during the suspension period. The rule will be reimposed on November 10, 2026.
