USTR seeks comments on extending China-related Section 301 exclusions

The Office of the United States Trade Representative (USTR) today released a notice requesting comments regarding the potential extension of 178 exclusions under the Section 301 investigation into China’s practices related to technology transfer, intellectual property, and innovation.

The exclusions, which have been extended multiple times, were most recently extended for 90 days through November 29, 2025 (read TradeNewsFlash). USTR is seeking input on whether these exclusions should be extended further. The evaluation will focus on factors such as the availability of products from sources outside China, efforts to source products domestically or from third countries, and the potential impact of further extensions on U.S. interests and the administration’s priorities.

The public docket for comments will be open from September 16, 2025, through October 16, 2025.
