U.S. CBP issues correcting amendments to USMCA regulations
Amendments address inadvertent omissions and errors in the January 2025 interim final rule
U.S. Customs and Border Protection (CBP) and the Department of the Treasury today released correcting amendments to the implementing regulations for the United States-Mexico-Canada Agreement (USMCA). These amendments address inadvertent omissions and errors in the interim final rule published in January 2025, which established preferential tariff treatment and related customs provisions under the USMCA. The January 2025 interim final rule amended CBP regulations to implement provisions related to general definitions, drawback and duty-deferral programs, textile and apparel goods, and automotive goods, among others. However, errant amendatory instructions resulted in the inadvertent omission of two conforming amendments and the removal of two unrelated paragraphs. The correcting amendments restore the omitted provisions, update references from the North American Free Trade Agreement (NAFTA) to the USMCA, and clarify the regulatory text.
