USTR requests comments on proposed modifications in Section 301 investigation of China's maritime sector

The Office of the United States Trade Representative (USTR) on June 6, 2025, posted on its website a request for comments on potential modifications to the trade action concerning the Section 301 investigation of China's targeting of the maritime, logistics, and shipbuilding sectors for dominance.

The USTR seeks input on several considerations:

  • For Annex III: The potential impact of implementing a fee based on net tons, the suggested amount for this fee, and the implications and suggested duration of a targeted coverage provision for the Maritime Security Program.
  • For Annex IV: The potential impact of removing the term providing for suspension of export licenses in paragraph (j), applying data collection requirements under paragraph (k) to vessel operators or owners, and applying Annex IV restrictions to vessel owners or operators.

Written comments on these proposed modifications must be submitted by July 7, 2025.

Background

The USTR initiated an investigation on April 17, 2024, into China's practices in the maritime sector, which have been deemed to disadvantage U.S. interests. Following a public report released on January 16, 2025, and subsequent public hearings, the U.S. Trade Representative determined that China's actions were unreasonable and burdensome to U.S. commerce.
