Australia: Legislation expanding first home buyer, “off-the-plan” duty concessions passes state Parliament (Western Australia)
Changes under legislation apply to transactions concluded on or after March 21, 2025.
The Duties Amendment Bill 2025, expanding the first homeowner duty and “off-the-plan” duty concession in Western Australia, has passed the state's Parliament.
Changes to the first homeowner duty concession in the legislation include:
- Increasing the exemption threshold for homes and vacant land by $50,000,* to $500,000 and $350,000, respectively
- Increasing the concession threshold for vacant land by $50,000 to $450,000, with the reduced rate of duty being applied to land valued between $350,000 and $450,000
- Reducing the rate of duty being applied to homes valued between $500,000 and $700,000 in the Perth metropolitan and Peel regions, and to homes valued between $500,000 and $750,000 outside those regions
Changes to the off-the-plan concession in the legislation include:
- Extension to the scheme by another 12 months to June 30, 2026
- 100% concession, capped at $50,000, available for eligible properties valued up to $750,000 that are purchased before construction commences (phasing down to a 50% concession for properties valued above $850,000, capped at $50,000)
- 75% concession, capped at $50,000, available for eligible properties valued up to $750,000, purchased while under construction (phasing down to 37.5% for properties valued above $850,000)
- Off-the-plan dwellings on single-tiered strata schemes and community titles (building) schemes (excluding survey-strata schemes) eligible for the duty concession for the first time
Changes made by the legislation apply to transactions concluded on or after March 21, 2025.
