White House issues executive order on “tariff non-stacking”

The White House on April 29, 2025, posted on its website an executive order signed by President Trump addressing the non-stacking of certain tariffs on imported articles. The order aims to prevent the cumulative effect of overlapping tariffs that exceed necessary duty rates to achieve policy goals.

The order applies to tariffs imposed under specific proclamations and executive orders, including those related to imports of automobiles, automobile parts, aluminum, steel, and duties addressing border security issues. It outlines a procedure to determine which tariffs apply when an article is subject to multiple tariff actions, ensuring that tariffs do not stack on top of one another.

The order is set to apply retroactively to entries made on or after March 4, 2025, with necessary changes to the Harmonized Tariff Schedule of the United States (HTSUS) to be implemented by May 16, 2025.
