The Department of Commerce’s Bureau of Industry and Security (BIS) today issued two temporarily denying export privileges for a Russian airline and a company based in Kenya for violations of the Export Administration Regulations (EAR).
- Renewal of temporary denial order: The BIS has renewed a temporary denial order (TDO) against a Russian airline for a period of one year following a pattern of repeated violations of the EAR. The airline has been found to operate aircraft subject to the EAR without the necessary BIS authorizations, including flights into and within Russia. The order prohibits the airline from participating in any transactions involving U.S.-origin items subject to the EAR, except those directly related to safety of flight and authorized by BIS. - Temporary denial order: A separate TDO has been issued against a company based in Nairobi, Kenya, along with its associates. The order, effective for 180 days, addresses attempts to procure and divert controlled aircraft parts from the United States to Russia, in violation of the EAR. The respondents have engaged in deceptive practices, including falsifying export documentation and transshipping items to Russia without authorization. Read the BIS notice
Background
As of February 24, 2022, the BIS implemented extensive controls on aviation-related items to Russia, including a license requirement for the export, reexport, or transfer of aircraft and parts specified under Export Control Classification Number (ECCN) 9A991. Additionally, effective March 2, 2022, BIS excluded aircraft registered in, owned, controlled by, or under charter or lease by Russia or Russian nationals from eligibility for the license exception Aircraft, Vessels, and Spacecraft (AVS).
