Portugal: Charges on telecom operators held unconstitutional (Constitutional Court decision)

Decision of Constitutional Court has retroactive effect.

The Constitutional Court on October 29, 2024, held that charges levied by the National Communications Authority (Autoridade Nacional de Comunicações or ANACOM) on telecom operators were unconstitutional because they were not established by law or decree-law.

The decision has retroactive effect and applies in all cases since the charges’ inception.
