The Office of the United States Trade Representative (USTR) today announced the opening of an electronic portal for submitting requests to exclude certain machinery used in domestic manufacturing from tariffs imposed under the Section 301 investigation into China’s technology transfer, intellectual property, and innovation practices. The portal opens today and will accept requests through March 31, 2025.
The Section 301 tariffs, initially imposed in response to China’s unfair trade practices, have been under review. Following a comprehensive review and a directive from the president, USTR is now inviting stakeholders to request temporary exclusions for specific machinery, particularly prioritizing solar manufacturing equipment.

Background
The USTR in September 2024 announced certain modifications to the actions taken in the Section 301 investigation of China’s acts, policies, and practices related to technology transfer, intellectual property, and innovation. Additionally, the USTR announced 14 temporary exclusions for solar manufacturing equipment and a list of subheadings eligible for consideration of temporary exclusion under an exclusion process for certain machinery used in domestic manufacturing.
