The European Commission (EC) has announced that it is imposing definitive countervailing duties on imports of battery electric vehicles (BEVs) from China for five years, effective the day after publication in the Official Journal. The investigation found that Chinese BEVs benefit from unfair subsidies, harming EU producers.
According to the EC release (October 28, 2024):
- Definitive duties will be collected from the entry into force date; provisional duties from 4 July 2024 will not be collected.
- The EC will monitor the measures to prevent circumvention.
- Exporters can request an accelerated review for an individual duty rate.
- Importers can request refunds if they prove their exporter is not subsidized or the subsidy margin is lower than the duties paid.
- Measures will expire after five years unless reviewed.
- The EU and China are seeking WTO-compatible solutions and may negotiate price undertakings with individual exporters.
