Costa Rica: New ultimate beneficial owner filing obligations

Various legal entities and figures, previously exempt, are now required to register and declare their ultimate beneficiary owners.

Resolution N°MH-DGT-RES-0020-2024/DG-336-2024 published on September 19, 2024, provides that various legal entities and figures, previously exempt, are now required to register and declare their ultimate beneficiary owners.

A third party can be authorized to file the declaration via a full power of attorney, which must be notarized. Obligated subjects include legal entities, trusts, administrators of third-party resources, and non-profit organizations as outlined in articles 5 and 6 of Law No. 9416. The procedure for registering information in the registry of transparency and final beneficiaries (RTBF) system is also established.
