Panama: Ownership threshold for controlling persons reduced under FATCA and CRS

Decree No. 25 reduces ownership threshold for entity accounts from 25% to 10%

The Ministry of Economy and Finance published Decree No. 25 (dated June 29, 2026), which reduces the ownership or control threshold for determining reportable controlling persons in relation to entity accounts from 25% to 10%.

The decree also allows reporting financial institutions to rely on anti-money laundering (AML) and know your customer (KYC) procedures to identify controlling persons of entity accounts. For reporting purposes, this includes treating trust settlors and foundation founders as controlling persons.
