Increased electronic invoicing-related audits and inspection visits due to non-compliance
The Colombian tax authority (DIAN) has increased electronic invoicing (e-invoicing)-related audits and inspection visits due to non-compliance with e-invoicing regulations.
Pursuant to currently enforceable tax regulations, when the e-invoice is not issued or when the e-invoice is not delivered following technical requirements, the Colombian tax authority can penalize the taxpayer with the closure of business premises for a period of three days.
When such a closure is proposed by the DIAN, the taxpayer can opt to pay an economic fine equivalent to 5% of the operational income of the previous month (no limits are applicable) instead of closure.
In accordance with different press releases during fiscal year (FY) 2023, approximately 355 Colombian taxpayers were sanctioned with this penalty.
The DIAN has publicly emphasized that in FY 2024, the e-invoicing audits and inspection programs have been and will continue to be increased since the DIAN keeps finding deficiencies in the taxpayers’ e-invoicing system and in the appropriate issuance and delivery of the e-invoice.
Therefore, Colombian taxpayers may need to assess whether their e-invoicing system parametrization is appropriate and complies with the technical requirements set forth in the enforceable regulations. The DIAN in November 2023 introduced modifications to the e-invoicing requirements through Resolution No. 165, which recently came into effect.
