Nigeria: NMDPRA’s right to impose and collect certain levies upheld (Federal High Court decision)

Authority to enact regulations related to the administration of midstream and downstream petroleum liquids operations

The Federal High Court (FHC) in Abuja issued a decision affirming the authority of the Nigerian Midstream and Downstream Petroleum Regulatory Authority (NMDPRA) to enact regulations related to the administration of midstream and downstream petroleum liquids operations.

The Federal High Court also upheld the NMDPRA's right to prescribe additional activities under a license or permit, as per the Petroleum Industry Act 2021 (PIA). The court further determined that the regulations set by the NMDPRA do not contradict certain sections of the PIA that provide for the imposition of levies for the authority fund and the midstream and downstream gas infrastructure fund (MDGIF) on wholesale customers.
