South Africa’s Minister of Home Affairs has published the draft 2021 Critical Skills List for public comments.1  This follows the announcement by the president of South Africa during the ‘State of Nation’ address concerning the final list and its reflecting the skills required to grow the country’s economy.  The list was developed by the Department of Higher Education and Training, through its Labour Market Intelligence Research Programme.

WHY THIS MATTERS

In terms of section 19(4) of the Immigration Act of 2002, the director general may issue a critical skills work visa to an individual possessing such skills or qualifications – and to those of their immediate family members – determined to be critical for the Republic from time to time by the minister through a notice in the government gazette.

It is essential for foreign individuals seeking work in South Africa, or being sent to South Africa by their employers for work, who possess skills or qualifications deemed to be critical and for employers with such employees (or seeking such employees) to review the draft critical skills list and provide their written comments to the Department of Home Affairs before 31 March 2021.
