国家税務総局が租税条約の実務に関する若干問題を公告

国家税務総局は2018年2月9日、中国政府が外国と締結した所得に対する租税に関する二重課税の回避条約を統一して規範化するため、租税条約に記載されている①「恒久的施設（PE）」、②「海運及び空運」、③「芸能人及びスポーツ選手」、④「パートナシップ制企業の租税条約適用」の各条項を改訂した「租税条約の実務に関する若干の問題に関する国家税務総局の公告」（2018年第11号、以下「11号公告」）を公布した。同公告は、2018年4月1日以降に納税と源泉徴収の義務が発生する租税条約上の優遇措置の適用が必要な実務に適用される。
