Clark has extensive experience in delivering anti-bribery and corruption (“AB&C”) and FCPA focused due diligence and investigation services for multinational companies. In recent years, he led several large-scale FCPA due diligence and regulatory-initiated FCPA investigations for pharmaceutical, medical device and industrial companies. During these engagements, he coordinated the investigative procedures and led the ground team, which included designing the work plan, performing document review and data analysis and carrying out in-depth interviews. He also has experiences of working with many prestigious law firms to report to regulators.
During his secondment in Switzerland, Clark has let several cross-boarder AB&C investigations for the Swiss headquartered companies, in which he reported directly to the Board of Directors. He also has exposures to the establishment of corporate compliance system for multinational companies, with reference to the international AB&C standards.
He has conducted many pro-active FCPA compliance and fraud risk management assessments in China. He took the leading role for an independent FCPA Defer-Prosecution-Agreement Regulatory Monitoring program, which required close working with an SEC designated external Monitor. The 3-year program included the review of the company’s design and improvement from multiple angles including but not limited to the tone at the top, policies and procedures, internal control environment, internal audit and investigation.
He has also conducted multiple financial report fraud related investigations, forensic data analysis, and e-Discovery projects.
In addition, Clark has three years’ experience in the Audit practice of another Big Four accounting firm in China, where he was largely involved in IPO audits, PRC statutory audits, US/IFRS reporting and other special audit engagements.
