Pursuant to Decree No. 69/2024/ND-CP (Decree 69), from 1 July 2025, all enterprises and organizations are required to register an electronic identification account (VNeID) in order to carry out administrative procedures and online transactions. However, due to certain practical challenges, this organizational electronic identification account (organizational eID) requirement for organizations has not yet been enforced uniformly in all cases.
In addition, according to Decree 69, registering level 2 VNeID for foreign individuals is voluntary; however, it is mandatory for foreigners being legal representatives of organizations/enterprises in Vietnam, such that the enterprises/organizations can carry out the registration of organizational electronic identification account (organizational eID) as a next step. Further, temporary resident card/permanent resident card is a mandatory document, among others, for foreigners to apply for an individual VneID.
In line with the Government’s efforts in digital transformation and data synchronisation, from 1 June 2026, all online procedures relating to immigration applications must be submitted via the organizational VNeID account, instead of being allowed to use, in parallel, with a traditional USB token to log in to the National Public Service Portal as before.
At present, the typical immigration procedures for foreign nationals that are required to be submitted via the organizational VNeID portal include:
- Applying for entry approval letters for foreign nationals and their dependents;
- Applying for visa extensions / work visas / exit visas;
- Applying for temporary residence cards.
As such, businesses who have not completed the registration of an organizational VNeID or the organizational VNeID inactive due to different reasons, might face disruption of mobility plan for inbound foreign employees as they cannot submit the immigration application to sponsor these employees to work in Vietnam.
Our Comments
Given the non-uniform implementation of the VNeID framework and the lack of a clear transition roadmap, businesses should anticipate potential disruption to immigration planning, particularly for newly established entities/organizations and for those whose legal representatives/head of organizations are based overseas and have not yet obtained a TRC.
In the absence of detailed guidance for cases where the legal representative does not yet hold a TRC, companies and organizations should, in the meantime, focus on completing the legal representative’s/head of organization’s work permit procedures as soon as possible. This will allow the TRC to be obtained and organizational VNeID to be carried out promptly once further guidance is provided.
As Decree 69 plans for work permit procedures to gradually move to the VNeID platform, employers should expect that work permit applications will be handled in the same way as immigration applications. Businesses are therefore encouraged to obtain the legal representative’s/head of organization’s work permit as early as possible to support timely registration of the organizational VNeID account.
In light of ongoing system integration and upgrades, businesses should also be prepared for potential technical issues (e.g. missing dossier codes, unsuccessful submissions, absence of appointment slips) and are recommended to closely monitor online submissions and follow up promptly with the authorities to help ensure timely processing.
