The Productivity Commission released a draft report of its review of philanthropic giving in Australia in which it proposed an overhaul of the system that determines which charities are eligible to receive tax-deductible donations.

The report finds that the current “deductible gift recipient” system is “poorly designed, overly complex and excludes many causes without a coherent policy rationale” and proposes a simpler, fairer, and more transparent process for determining which charities can receive tax-deductible donations.

The report also recommends that the government support the establishment of an Aboriginal and Torres Strait Islander philanthropic foundation, as well as reforms that would improve the regulatory framework for charities, including supporting the role of the Australian Charities and Not-for-profits Commission’s (ACNC) charity register in providing further useful information for donors.

A final report will be provided to government in the first half of 2024.
