Guidance for foreign financial institutions that are unable to obtain and report U.S. TINs

The Spanish tax authority on 13 March 2023 issued updated FATCA “frequently asked questions” (FAQs) following the issuance of IRS Notice 2023-11, which provides temporary relief procedures for certain foreign financial institutions required to report U.S. taxpayer identification numbers (TINs) for certain preexisting accounts as defined in an applicable Model 1 intergovernmental agreement (IGA).

The updated FAQs provide guidance for foreign financial institutions that are unable to obtain and report U.S. TINs of pre-existing U.S. reportable accounts.
