We advise on the structuring, assessment, and notification of concentrations before the Portuguese Competition Authority and the European Commission, as well as the coordination of simultaneous filings with multiple national competition authorities.
We advise on agreements between competitors and vertical cooperation arrangements between businesses, including distribution, agency, and franchise agreements. We also provide counsel in matters involving abuse of a dominant position, abuse of economic dependence, and unilateral restrictive trade practices, helping clients assess risks, structure compliant commercial relationships, and navigate competition law requirements.
We assist clients in the design and implementation of compliance programs, internal training initiatives, risk audits using e-discovery tools, and policies aimed at preventing and mitigating competition law infringements. Our approach helps strengthen a culture of compliance, enhance risk awareness across the organization, and promote adherence to applicable competition regulations.
We advise clients on the identification, structuring, and notification of measures that may qualify as State aid, including interactions with national and European authorities. Our experience also extends to providing legal counsel on public incentive schemes, as well as representing clients in the related administrative and contentious proceedings before national and European authorities, working in close collaboration with our Public Law team and KPMG’s Tax practice.
Advising on European Union law and sector-specific regulation, including regulatory frameworks, regulatory oversight, and engagement with national and European authorities, in close collaboration with our Public Law and Environment & ESG teams. We also provide support in European Union litigation matters involving the application of internal market principles and rules, including infringement proceedings against the Portuguese State and actions for annulment of decisions issued by the European Commission and other EU institutions across a range of sectors.
