On February 10, 2026, the Ontario Superior Court of Justice (Commercial List) (the "Court") issued an order (the "Initial Order") pursuant to the Companies' Creditors Arrangement Act (the "CCAA"). The Initial Order provided for certain relief and protection against LJM Developments (Hamilton) Inc. ("LJM Hamilton") and appointed Schwartz Levitsky Feldman Inc. ("SLF") as monitor of LJM Hamilton in the CCAA.
On February 20, 2026, at the Comeback Motion, the Court issued an amended order (the "Amended and Restated Initial Order"), among other things, approving the replacement of SLF as Monitor and appointing KPMG Inc. ("KPMG") as Court-appointed monitor of LJM Hamilton.
On April 8, 2026, the Court issued an order (the “Lien Claims Process Order”) approving the construction lien claims process (the “Lien Claims Process”) to identify, quantify, and resolve certain claims of creditors of LJM Hamilton. Any person that wishes to assert a Construction Lien Claim must deliver to the Monitor on or before the Claims Bar Date a completed Proof of Construction Lien Claim form, including all relevant supporting documentation in respect of such Construction Lien Claim, in the manner as set out in the Lien Claims Process Order. The Lien Claims Process Order provides for a Claims Bar Date of 5:00 p.m. (Toronto Time) on May 1, 2026.

Please note, it is your responsibility to ensure that the Monitor receives your Proof of Construction Lien Claim by the Claims Bar Date if you wish to assert any Construction Lien Claim. LIEN CLAIMS WHICH ARE NOT RECEIVED BY THE CLAIMS BAR DATE WILL BE BARRED AND EXTINGUISHED FOREVER.
