In accordance with image copyrights (or "portrait rights") that derive from the legislation on the protection of privacy and Article XI. 174 of the Belgian Code of Economic Law (CEL), you hereby give permission to KPMG Central Services VOF/SNC, having its office at Luchthaven Brussel Nationaal 1K, 1930 Zaventem, Belgium and registered under company number 0473.719.789, RPR/RPM Brussels (hereafter referred to as “KPMG”) to (let) create, upload, use, store, reproduce and/or publish direct and indirect, individual and group, photos and/or videos of you that may be taken during events, in the context of marketing campaigns, interviews, etc. within the Belgian KPMG network1 (hereafter referred to as the "Images").
You confirm that the Images may be shared with other entities of the Belgian KPMG network and used for the publication on KPMG’s communication media, such as:
- Websites of any entity of the Belgian KPMG network (such as kpmg.com/be, kpmglaw.be);
- Online photo albums of any entity of the Belgian KPMG network;
- Communication tools of any entity of the Belgian KPMG network (such as emails, newsletters, PowerPoint presentations, digital flyers, etc.);
- Printed materials of any entity of the Belgian KPMG network (such as posters, flyers, brochures, promotional material, etc.);
- Social media channels of any entity of the Belgian KPMG network (such as LinkedIn, Twitter, Facebook, Instagram, YouTube).
You also confirm that the Images can be used and stored according to the above-mentioned provisions. The precise retention time will depend on the purposes for which the Images are used. For example, the Images may be stored for the following periods:
- Events: maximum period of three (3) years after the end of the relevant event, unless you give your permission for an additional period;
- Marketing campaigns: as long as the campaign is running with a maximum period of three (3) years, unless you give your permission for an additional period.
You hereby declare that you expressly waive your copyright as well as all your rights to portraits and videos that may arise from the Images and you explicitly transfer those rights to KPMG. You also declare that you make no claim to any kind of compensation for those waivers, nor for the use of the Images.
You acknowledge and agree that if you are no longer a representative of the company for which you allow KPMG to create (or have created) and use the Images as stated above, the permission and rights granted to KPMG remain in force until the end of the above-mentioned period of (3) three years.
You acknowledge that KPMG will publish the Images only with "due care and attention" and will not distribute and/or publish Images of you that compromise your good name and/or reputation.
Finally, you understand that the Images also constitute personal data within the meaning of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”) and that they will be processed in accordance with KPMG’s Privacy Notice.
