Terms and Conditions

 

Participation to the ESG Conclave and Awards shall be subject to the terms and conditions hereinafter:

 
  • The participants will be judged by a panel of selected judges who may make suitable changes to the scoring parameters at their discretion. The decision of the panel of judges will be final and binding. We will not enter into any correspondence or discussion with any participant nor will we accept any submissions, representations or appeals with regard to such decision. The judges reserve the right not to select a winner for a particular category/sector and/or make any particular award in any given category.
  • You expressly agree that we shall be entitled to refer to you in connection with the Awards in sales and marketing literature (including on our website) and reproduce your logo and/or trade mark for that sole purpose. To the extent that you provide us with Personal Data in connection with the ESG Conclave and Awards, our Privacy Notice (as set out on our website) shall apply to the provision of such Personal Data to us.
  • You agree that we shall not (whether in contract, tort, negligence, statutory duty or otherwise) be liable to you in connection with the ESG Conclave and Awards for any direct, consequential, indirect, punitive, exemplary, incidental, remote or special damages (including indirect loss of profit and indirect loss of revenue) whatsoever.
  • Any dispute or claim arising out of or in connection with the ESG Conclave and Awards shall be exclusively governed by laws of India and shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
  • The jury follows strict guidelines on confidentiality as well as to provide a fair and impartial evaluation. The jury members commit to act fairly and impartially to the best of their ability in their jury duties. The jury members are leaders from various stakeholder groups and are independent and have no association in an executive management role with any of the shortlisted companies. In the event that there are one or more companies where a jury member is involved with in another capacity that poses a conflict of interest, the jury member abstains from judging that company.
 

Limitations and Caveats


  • The participants are shortlisted and evaluated based on data compiled by our data partner S&P Global and other publicly available information. ESG reporting is still evolving, and therefore there are limitations with respect to the availability, quality, consistency and comparability of information disclosed by companies. Accordingly, this assessment will not be able to accurately assess or predict the extent to which the documented practices are followed by a company. As all evaluation frameworks do, the methodology followed for the KPMG ESG Conclave and Awards could also therefore have its own limitations.
  • A company’s scoring or selection does not guarantee permanency of any specific ESG practices, nor does it opine on a company’s corporate policies or internal controls and practices, which may vary from time to time. The short-listing of a participant or selection of a winner in any particular category, therefore, does not indicate their current or future sustainability or ESG or financial performance nor it is intended to be a recommendation or opinion on the suitability of such performance.
  • While a company that scores well across Environmental, Social and Governance may exhibit strong environmental, social or governance policies and procedures and may have better risk management measures, we do not in any way guarantee that the participants, including any of the winners, will always adhere to good corporate governance and ESG practices, especially during disruptive or conflict-based situations. It may also be the case that a company may change its behaviour following a change in internal or external factors leading to change in their ESG practices. The evaluation results must therefore not be used to predict future stock price, financial/ESG performance or their sustainable growth. The jury may decide to not select a winner for a particular sector, or a domain based on their review due to lack of adequate comparable data or for other reasons, and the jury's decision will be final and binding.
  • We shall not (whether in contract, tort, negligence, statutory duty or otherwise) be liable to anyone in connection with the KPMG ESG Conclave and Awards (including its evaluation methodology or scoring framework) for any direct, consequential, indirect, punitive, exemplary, incidental, remote or special damages (including indirect loss of profit and indirect loss of revenue) whatsoever.
