The Indian TP landscape has constantly been shaped as much by litigation as by legislation. Over the last two decades, we have witnessed protracted litigations, with several TP issues reaching the High Courts and the Supreme Court.

In a recent ruling, the Supreme Court has overturned various High Court decisions on TP issues related to comparable data and remitted them back to the High Courts for fresh adjudication. Majority of such issues, considered as largely factual, for which Tribunals’ adjudication was considered final, may now see longer litigation timelines.

Recent assessment trends and legislative developments further suggest that TP issues would continue to be litigative and need a long-term dispute resolution strategy.
