中国国家税務総局は、2020年3月に出版した「租税条約実施事例集」において恒久的施設（PE：Permanent Establishment）に関わる事例を2件取り上げた。この2事例から、中国税務機関は、契約に基づく各プロジェクトの関連性に対して調査し、個々の契約に関連性があると認定された場合、外国法人がこれらの契約を履行するために中国に派遣した職員全員の中国における滞在期間を合算して、183日ルールに基づきPEに該当するか否かを判断することが明らかになった。...
