The U.S. Department of Commerce’s Bureau of Industry and Security (BIS) today released an interim final rule that revises the Export Administration Regulations (EAR) to address dual-use concerns about biotechnology. The rule institutes new controls on certain biotechnology equipment and related technology and solicits public comments on the changes.
The interim final rule establishes new Export Control Classification Numbers (ECCNs) for high-parameter flow cytometers and liquid chromatography mass spectrometers designed for top-down proteomics. These items are now controlled under ECCN 3A069, with corresponding technology under ECCN 3E069.
The rule specifies license requirements and review policies, with a presumption of denial for certain destinations and case-by-case review for others. The rule also revises the filing requirements for Electronic Export Information (EEI) in the Automated Export System (AES) for these items.
Comments are due 60 days after publication in the Federal Register, which is scheduled to be January 16, 2025.
