Brazil: Potential new increase in user fee for integrated foreign trade system

A new increase in the SISCOMEX fee may be on the horizon in 2022.

The user fee for the Brazilian Integrated Foreign Trade System (Sistema Integrado de Comércio Exterior—SISCOMEX) charged on imports into Brazil may see a new increase in 2022.

The SISCOMEX fee was increased by almost 500% in 2011, and that disproportionate increase was subsequently held to be unconstitutional by the Supreme Federal Court of Brazil, thus allowing importing companies to seek refunds of excess SISCOMEX fees paid.

However, a new increase in the SISCOMEX fee may be on the horizon in 2022. Two factors appear to present a favorable scenario for an increase: (1) Brazil’s growing investments in the SISCOMEX portal, and (2) the law establishing the current SISCOMEX fee states that those values were established based on the monetary correction of the period from December 1998 to February 2021, and the anniversary of that reference date has arrived.
