The Bureau of Internal Revenue (BIR) has issued the following:
Revenue Memorandum Circular (RMC) No. 36-2019, 18 March 2019, circularizing the additional lists of withholding agents required to deduct and remit the 1% or 2% Creditable Withholding Tax (CWT) for the purchase of goods or services under Revenue Regulations (RR) No. 11-2018. The said RMC also provides for the list of de-listed withholding agents who are no longer required to deduct the said CWT. The lists are already available in the BIR website for the convenience of all concerned.
The obligation to deduct and remit CWT from the income payments to suppliers of goods or services shall continue, commence or cease, as the case may be, effective 1 April 2019. Note that any taxpayer that cannot be found in any of the published lists of inclusions is deemed to have been excluded and therefore not required to deduct and remit the 1% or 2% CWT under RR No. 11-2018.
RMC No. 37-2019, 18 March 2019, circularizing the availability of the enhanced annual income tax return for individuals, estate and trusts (BIR Form No. 1701) including estates and trusts. The reason for this revision is due to the implementation of the Tax Reform for Acceleration and Inclusion (TRAIN) Law. The RMC advises the individual taxpayers (including mixed income earners), estates and trusts to use the newly revised BIR Form No. 1701 in filing and paying the income tax due starting 2018 that is due on or before 15 April 2019.
The revised manual return is already available in the BIR website under the BIR forms-income tax return section. However, the form is not yet available in the electronic filing and payment system (EFPS) and electronic BIR forms (eBIRForms). Consequently, eFPS and eBIRForms filers shall use manual return in filing and paying the income tax due thereon. Revenue District Offices (RDOs) shall receive the manually-filed returns by the taxpayers (either no payment returns or returns with payments made online). Further, a revenue issuance shall be released once the revised return is available in eFPS and eBIRForms package.
