The Bureau of Internal Revenue (BIR) issued a tax advisory instructing all users of the Electronic Documentary Stamp Tax (eDST) System to adopt the constructive stamping procedures under Revenue Memorandum Circular No. 01-2010 dated 04 January 2010, for their DST transactions covering the period from 01 January 2018 to 05 January 2018. This is pending the adjustment of the new DST rates under Republic Act No. 10963 (TRAIN Law) in the eDST System on 06 January 2018.
However, in adopting the constructive DST stamping, the account balance maintained by the concerned eDST System users in the said system, cannot be utilized in the payment of the DST due on the taxable documents. For this purpose, a separate DST declaration/return (BIR Form No. 2000) will have to be filed and the tax due thereon shall be paid by the concerned eDST System users.
Finally, the summary of the detailed transactions covered by the foregoing DST payment and constructive stamping procedures shall be transmitted to the BIR via email to the following email addresses on the day immediately after the constructive stamping and payment of the DST:
