Stamp Duty showdown: What LHDN's enforcement means for you

Starting in 2026, the move to self-assessment will require businesses to independently determine what needs to be stamped, apply the correct duty, and ensure documentation is in order, or risk audit and penalties.

Soh Lian Seng, Head of Tax at KPMG in Malaysia, went on air alongside the Inland Revenue Board (IRB) of Malaysia's Director of the Stamp and RPGT Operation Department, Shafudin Yacob, to unpack the new stamp duty rules, gray areas, and how businesses can prepare ahead. 

From mapping stampable documents to embedding checks in contract workflows, they agreed that organizations will need to relook at internal processes to stay compliant. They also acknowledged that uncertainties remain — particularly around documents like promotion and transfer letters, or variable-fee intercompany agreements — making it all the more important for businesses to seek clarity ahead.
