Mobilization of Talents to Malaysia - Tax and Immigration Perspective

For global companies which move talents across borders, whether on short-term or long-term assignments, tax and immigration issues will continue to exist as crucial issues that need to be addressed. It is therefore critical for companies to take a step back and examine the activities of this workforce to ensure whether there is any undesirable exposure at either the employee or corporate level, moreover when incorporating the remote working arrangement as a norm.

Further, there may be an exposure on the overseas company of having a permanent establishment (PE) in Malaysia.
