      Information on the processing of personal data

      KPMG Baltics SIA (reg. No.40003235171, legal address: Roberta Hirša iela 1, Riga, LV-1045, Latvia) and KPMG Law ZAB SIA (legal address: Roberta Hirša iela 1, Riga, LV-1045, Latvia) (hereinafter also KPMG or we), each as an independent controller of personal data processing, within the framework of the processing of your personal data, undertake to protect your privacy within the framework of the personnel selection process.

      Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter - the Regulation), as well as other applicable external laws and regulations of the Republic of Latvia, shall be applicable to the processing of personal data by KPMG.

      We are committed to protecting and respecting your privacy. This KPMG Recruitment Privacy Policy outlines your privacy rights regarding the personal data we process during our recruitment procedures. It aims to ensure that you are informed of how your information is handled and protected throughout the selection process.

      What is personal data and their processing

      Personal data is any information or pieces of information relating to a natural person (data subject) that can be identified directly (for example, by referring to your name) or indirectly (for example, by referring to an e-mail address).

      This means that personal data may include your e-mail/residence address, mobile phone number, usernames, picture, personal preferences and information about education and previous work experience.

      The processing of personal data is any operation or set of operations performed on personal data or sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration.

       

      What this policy applies to

      This privacy policy applies to the processing of personal data, which is carried out when receiving and examining applications of natural persons for work at KPMG.

      We appreciate your interest in job opportunities at KPMG and are glad to receive your applications for both current vacancies and later candidate selection processes.

       

      When and what personal data you transfer to us

      In order for you to participate in the KPMG recruitment process, we need and process the following personal data about you:

      ·       surname;

      ·       name;

      ·       language skills;

      ·       information on education;

      ·       phone number;

      ·       e-pasta addresses;

      ·       information on previous work experience;

      ·       information contained in the application documents (the application documents are: motivation/application letter, CV, reviews, certificates of education and others)

      ·       assessment (e.g. test) results during the screening process.

      The submission of the listed personal data is mandatory for you to participate in the KPMG recruitment process.

      In your application for a vacancy announced by KPMG, we invite you not to provide KPMG with such personal data that are not previously specified as mandatory for participation in the KPMG recruitment process. The following personal data, for example, is your:

      ·       Your photo;

      ·       age information;

      ·       information on national or ethnic origin;

      ·       information about the state of health, pregnancy;

      ·       criminal records;

      ·       information about marital status;

      ·       information on membership of a political party, workers' trade union or other public organisation;

      ·       information about religious or philosophical beliefs or affiliation with a religious denomination;

      ·       information about sexual orientation;

      ·       etc. personal data that are not expressly indicated as mandatory to be submitted.

      KPMG has the right to delete the personal data sent to it, which is not necessary for the evaluation of your application for KPMG vacancies.

       

      Legal basis for the processing of personal data – consent

      A.    Your consent as a data subject when applying for a specific position or positions

      If you apply for a specific position or positions at KPMG, then as a result of such action, KPMG receives and uses your personal data on the basis of your consent only in competitions for the position or positions selected by you.

      Consent is given by submitting your activity – the application and the information attached to it, including personal data, within the framework of the KPMG selection process.

      Consent has the right to withdraw at any time by sending a request to the datu_iesniegumi@kpmg.lv or datu_iesniegumi@kpmglaw.lv. In this case, all personal data submitted by the candidate on the basis of the specific consent will be deleted.

      By submitting your application to KPMG, including your personal data, to apply for a position at KPMG, you certify that you are at least 18 years old.

      B. Your consent as a data subject to other job competitions, the storage of your data in the KPMG candidate database

      If, after applying for your candidacy, you are not selected for the position for KPMG for which you have previously applied, but you want KPMG to retain your application, including your personal data containing it, for use in other job competitions, then you have the opportunity to give your consent to such processing of your personal data by KPMG by making a mark and as a result KPMG will be able to store and use your personal data for six months after it is submitted to KPMG. The legal basis for the storage and use of such personal data is your consent and KPMG thus provides an opportunity to efficiently carry out the selection of employees by creating a database of candidates for future job competitions and without announcing job competitions publicly and for you, without submitting an additional application, it is possible to apply for those vacancies for which you have not submitted an application to KPMG.

      You have the right not to give this consent, as well as in the event that you have given it, then withdraw it at any time by sending a request to the datu_iesniegumi@kpmg.lv or datu_iesniegumi@kpmglaw.lv. In this case, all personal data submitted by you on the basis of the specific consent will be permanently deleted.

      Submission of other personal data

      You have the right to submit to KPMG the personal data of others only in exceptional circumstances, for example by submitting the personal data of the person who provides or could provide KPMG with feedback on your previous work experience. In such cases, you, as the controller, are responsible for fulfilling the legal basis for submitting this personal data to KPMG and other applicable requirements.

        

      Duration of storage of personal data

      Your personal data obtained on the basis of your consent shall be stored until such consent is withdrawn, but in any case, no longer than six months after:

      ·       the date of submission of your application for the specific vacancy announced by KPMG and the submission of your personal data;

      ·       Your consent to KPMG retaining your data for use in other job competitions.

      After the occurrence of the above-mentioned circumstances, your data is permanently deleted. If you enter into an agreement with KPMG for the commencement of an employment relationship within these six months, KPMG will store and process your data in accordance with the concluded agreement and the personal data processing rules included therein.

       

      How KPMG protects your personal data

      In order to protect your personal data and ensure its security, KPMG has implemented appropriate technical and organizational measures for the security of personal data. We regularly update and test our security systems. KPMG ensures that your personal data is only available to those KPMG persons who need it to perform their job duties as part of the evaluation of your application. In particular, KPMG conducts regular employee training to ensure the privacy, security and confidentiality of data.

       

      Your rights as a data subject

      In accordance with applicable personal data protection law, including Articles 12 to 22 of the Regulation, you have the following rights in relation to the processing of your personal data by KPMG:

      ·       obtain additional information about KPMG's processing of your personal data and request a copy of your personal data held by KPMG;

      ·       ask for the correction of your personal data (if you find that the information held by KPMG about you is incorrect or incomplete);

      ·       withdraw your consent to the processing of personal data (you have the right to withdraw the consent given by KPMG to the processing of personal data at any time);

      ·       to request the deletion of your personal data, termination of processing;

      ·       to request the restriction of the processing of personal data (marking of your personal data held by KPMG with the aim of restricting their processing in the future);

      ·       ask for data portability (possibility to receive your personal data in a machine-readable format);

      ·       object to KPMG's processing of your personal data based on KPMG's legitimate interests.

      These rights are not absolute and their exercise may be restricted. For example, KPMG has the right to refuse you to stop processing personal data if KPMG indicates compelling legitimate reasons for the processing that override your interests, rights and freedoms.

      Potential recipients of data

      Your personal data is generally processed in the European Union. However, certain processing operations may require the transfer of your personal data to the United Kingdom. The European Commission has recognised that the UK ensures an adequate level of data protection, so no additional authorisation or additional security measures are required for such transfers.

      There may be situations where your personal data is transferred for processing to KPMG service providers, such as our (IT) system providers, recruiters, more information about the personal data processors or controllers used by KPMG is available in KPMG's general privacy policy.

      The role of such service providers in the processing of your personal data is the processor and KPMG, as the controller of the processing of your personal data, is responsible for the processing of your personal data by the service providers chosen by it. KPMG uses service providers if they comply with the personal data processing and security standards specified in external regulatory enactments.

      Data subject's right to lodge a complaint

      Our activities regarding the protection of personal data are supervised by the Data State Inspectorate. In order to resolve any disagreements or misunderstandings as soon as possible, please contact KPMG first using the contact information provided in this policy.
