EU: Directive 2019/1160 Transposition Update - Belgium and the Netherlands

On 2 August 2021, a new law will enter into force in Belgium concerning the distribution of foreign funds in the country, transposing the EU Directive 2019/1160 without additional gold-plating. This means that a physical presence for the fulfilment of facilities services in terms of payments and information to investors will no longer be required in Belgium as of 2 August 2021.
The new law amends the previous laws from 3 August 2012 (for UCITS) and from 19 April 2014 (for AIFs).
It is currently only available in French and can be accessed in full here.
The Netherlands
On 1 July 2021, the Dutch Act on Financial Supervision has been amended to transpose the requirements from the EU Directive 2019/1160 related to the marketing of foreign UCITS, as well as foreign AIFs in the Netherlands without additional gold-plating.
The updated law is currently only available in Dutch and can be accessed in full here.
