Since 10 January 2023, the amendments to the Code of the Republic of Kazakhstan “On Subsoil and Subsoil Use” dated 27 December 2017 No.125-VI have been put into effect in relation to the dispute resolution procedure related to subsoil use.1
According to the amendments, Kazakhstani subsoil users have the right to resolve disputes arising under a contract for exploration and production or production of hydrocarbons on complex projects in arbitration of the Republic of Kazakhstan, including the Astana International Financial Center, or outside the Republic of Kazakhstan.
Meanwhile, the choice of the venue of dispute resolution shall be carried out by the subsoil user of its choice in accordance with the terms of the contract for exploration and production or production of hydrocarbons for complex projects.
