Protected Disclosures (Amendment) Act 2022

The Protected Disclosures (Amendment) Act 2022 was signed into law in July 2022 and came into operation on 1 January 2023. This is an update to existing protected disclosure legislation for EU Whistleblowing Directive (2019/1937). Employers need to act now to ensure that they are fully compliant by December 2023.

Whistleblowing Channel Services

  • allocates a unique report reference that facilitates ongoing communication with whistleblowers even if they submit an anonymous report.

  • can be supported by a tailored voicemail messages to enable whistleblowers to make verbal reports.
  • includes metrics to track the status of whistleblowing reports, ensuring feedback is provided within the timescales required by the protected disclosure legislation. This includes acknowledgement of reports within seven days, diligent follow ups and provision of further feedback in three month intervals.

The independent KPMG case management team, based in Ireland, receive the reports that are made through the KPMG Whistleblowing Channel. The case management team are experienced professionals with relevant local knowledge and have been trained to handle sensitive data.
