Novi zakon o javnoj nabavi

Dana 1. siječnja 2017. godine stupio je na snagu novi Zakon o javnoj nabavi, objavljen u Narodnim novinama br. 120/2016. Prvenstveni razlog donošenja Zakona leži u potrebi daljnjeg usklađivanja s pravnom stečevinom Europske unije. The new Public Procurement Law, published in the Official Gazette No. 120/2016, came into force on 1 January 2017. The purpose of the new Law is to further harmonize the Croatian public procurement legislation with the EU directives.

Novi Zakon o javnoj nabavi

Dana 1. siječnja 2017. godine stupio je na snagu novi Zakon o javnoj nabavi, objavljen u Narodnim novinama br. 120/2016.  Prvenstveni razlog donošenja Zakona leži u potrebi daljnjeg usklađivanja s pravnom stečevinom Europske unije.

U nastavku navodimo neke od najznačajnijihpromjena koje donosi novi zakon:

  • Europska jedinstvena dokumentacija o nabavi (ESPD) postaje obvezna.  ESPD predstavlja formalnu izjavu gospodarskog subjekta koja služi kao preliminarni dokaz kojim se potvrđuje da određeni ponuditelj udovoljava propisanim kriterijima za odabir.  ESPD je potrebno dostaviti za ponuditelja, za podugovaratelja, ali i za sve subjekte na čiju se sposobnost ponuditelj oslanja; 
  • Da bi se osigurao najbolji omjer između cijene i kvalitete, od 1. srpnja 2017. godine jedini kriterij za odabir bit će „ekonomski najpovoljnija ponuda“, pri čemu relativni ponder cijene neće smjeti biti veći od 90% (uz određene iznimke). Dosadašnji kriterij najniže cijene više se neće smjeti primjenjivati;  
  • Kako bi se omogućila veća transparentnost, prije pokretanja određenih postupaka javne nabave, naručitelj je obvezan staviti na raspolaganje podatke o predmetu nabave i provesti prethodno savjetovanje sa zainteresiranim gospodarskim subjektima.  Naručitelj je obvezan razmotriti sve primjedbe i prijedloge te izraditi izvješće o prihvaćenim i neprihvaćenim primjedbama i prijedlozima.  Predmetno izvješće naručitelj je dužan objaviti na svojim internetskim stranicama;
  • Jamstva za ozbiljnost ponude ne smiju biti u iznosu višem od 3% procijenjene vrijednosti nabave, dok jamstva za uredno ispunjenje ugovora ne smiju biti u iznosu višem od 10% od vrijednosti ugovora bez PDV-a; 
  • Ponuditelj se i dalje može osloniti na sposobnost drugih subjekata.  Međutim, na obrazovne i stručne kvalifikacije ili stručno iskustvo drugih subjekata može se osloniti samo ako će ti subjekti izvoditi radove ili pružati usluge za koje se ta sposobnost traži.  Ako se ponuditelj oslanja na sposobnost drugih subjekata radi dokazivanja ispunjavanja kriterija ekonomske i financijske sposobnosti, naručitelj može zahtijevati njihovu solidarnu odgovornost za izvršenje ugovora iako nemaju status podugovaratelja; 
  • Ponuda dostavljena putem Elektroničkog oglasnika javne nabave obvezuje ponuditelja u roku valjanosti ponude neovisno o tome je li potpisana ili nije;
  • Rok za žalbu u otvorenim postupcima javne nabave iznosi 10 dana, neovisno o vrijednosti nabave (za razliku od roka od 5 dana koji je ranije bio propisan za postupke nabavemale vrijednosti);
  • Smanjeni su određeni iznosi naknada za pokretanje žalbenog postupka pred Državnom komisijom, a upravna pristojba je ukinuta.  Međutim, bude li žalba predana bez dokaza o izvršenoj uplati naknade za pokretanje žalbenog postupka ili naknada za pokretanje žalbenog postupka nije plaćena u propisanom iznosu, Državna komisija
    više neće pozivati žalitelja na uplatu naknade, već će takvu žalbu odbaciti bez pozivanja žalitelja da je dopuni; 
  • Državna komisija će povodom žalbe po službenoj dužnosti paziti na određene bitne povrede postupka javne nabave navedene u Zakonu;
  • Umjesto upravnih sudova, Visoki upravni sud Republike Hrvatske postaje nadležan za postupanje u upravnim sporovima protiv odluka Državne komisije.  Odluka u upravnom sporu mora se donijeti u roku od 30 dana, a ako Visoki upravni sud poništi odluku Državne komisije, svojom će presudom odlučiti o žalbi u postupku javne nabave.  Odluke Visokog upravnog suda objavljivat će se na internetskoj stranici Državne komisije.

The New Public Procurement Law

The new Public Procurement Law, published in the Official Gazette No. 120/2016, came into force on 1 January 2017.  The purpose of the new Law is to further harmonize the Croatian public procurement legislation with the EU directives.

We set out below some of the most important changes introduced by the new Law:

  • Submission of the European Single Procurement Document (ESPD) becomes mandatory.  The ESPD is a self-declaration form which serves as preliminary evidence that a particular bidder fulfils the relevant prescribed selection criteria.  An ESPD will have to be delivered for each bidder, as well as any sub-contractor and any other entity that the bidder relies upon submitting its bid; 
  • To ensure the best ratio between the price and the quality, on 1 July 2017, the “most economically advantageous bid” becomes the sole criteria for selection, whereby the relative weight given to the price cannot be more than 90% of the overall assessment mark (with some exceptions).  The previously used criteria of the lowest price will no longer apply as the sole selection criteria;  
  • To achieve a greater transparency, prior to commencing some specific types of public procurement processes, the contracting authority will be required to announce the intended procurement process and to undertake a preliminary consulting procedure with interested bidders.  The contracting authority will be required to consider all received remarks and suggestions and prepare a report setting out which remarks have been accepted and which have been dismissed.  The
    report will have to be published on the contracting authority’s web page;  
  • Required bid guarantees cannot exceed 3% of the estimated value of procurement, while performance guarantees will be capped at 10% of the contract value without VAT;  
  • In submitting a bid, a bidder can still rely on the capacity of other parties. However, in the event that a bidder is relying on educational and professional qualifications or relevant professional experience of a third party, then those professionals on whose references the bidder is relying will actually have to perform the work or services at issue.  In the event of a bidder relying on third parties to prove its economic and financial capacity to perform the particular work or services, the contracting authority may require such third parties to be jointly and severally liable with the bidder for the performance of the contract even if they are not formally subcontracted for the services;
  • A bid submitted through the Electronic Public Procurement Classifieds is binding on the bidder regardless of whether it has been formally signed;  
  • The deadline for appealing a selection in an open public procurement process will be 10 days, regardless of the value of the procurement (as opposed to the deadline of 5 days that was previously applicable to small value procurements);  
  • Some of the fees for filing an appeal before the State Commission have been reduced, while the administrative fee has been abolished.  However, in the event of filing an appeal without a satisfactory proof of payment of the appeal fee, or in the event of an insufficient fee being paid, the State Commission will no longer invite the appellant to pay the proper fee, but will immediately reject the underlying appeal;
  • When deciding on an appeal, the State Commission will ex officio examine whether one of the material breaches of the public procurement process set out in the Law has been committed;  
  • Instead of the Administrative Courts that were previously responsible for dealing with administrative actions brought with respect to decisions of the State Commission, those actions will now be considered by the High Administrative Court of the Republic of Croatia.  The High Administrative Court will be required to decide such actions within 30 days, and in the event of an annulment of a decision of the State Commission, the Court itself will render the decision.  The decisions of the High Administrative Court will be published on the web page of the State Commission.
