On 27 March 2023, the Danish government announced that the deadline for submitting a Brexit application will be extended.

The requirement for meeting the conditions to be eligible for a Brexit permit based on the Withdrawal Agreement continue to apply. This means that the applicant must have taken up legal residence in Denmark under the EU regulations before the end of the transition period on 31 December 2020.

The authorities do not know when the extended deadline will come into effect. In the meantime, the Danish Immigration authorities will continue to process Brexit applications. Applications where it is evaluated that there are no acceptable reasons for submitting the application late will be put on hold.  Applicants who have received a rejection based on the evaluation that there are no acceptable reasons for submitting the application late can re-apply for a Brexit permit.

The extension of the deadline is only an option for applicants who have not applied for a Brexit permit in time but meet the conditions of the Withdrawal agreement (resided in Denmark before 31 December 2020).

We will be out with an update as soon as the Danish government has announced when the extended deadline will come into effect. We expect to have an update ready no later than mid-May 2023.
